Laboral: Diferencia entre un acto administrativo y un acto de la administración

A través de la Resolución de Intendencia N°016-2021-Sunafil/IRE-APU, recaída en el expediente sancionador 028-2020-Sunafil-IRE-APU, la SUNAFIL ha precisado la diferencia entre un acto administrativo y un acto de la administración.

Actuaciones inspectivas

De acuerdo al ente, las actuaciones inspectivas son las diligencias que la Inspección del Trabajo sigue de oficio, con carácter previo al inicio del procedimiento administrativo sancionador, para comprobar si se cumplen las disposiciones vigentes en materia sociolaboral y poder adoptar las medidas inspectivas que en su caso procedan, para garantizar el cumplimiento de las normas sociolaborales.

La superintendencia nacional de fiscalización laboral precisa que la naturaleza de las actuaciones inspectivas y el acta de infracción en el procedimiento investigatorio no son actos administrativos, por el contrario son actos de la administración, formando gran parte de las piezas procedimentales de los expedientes administrativos, considerándose actos no productores de efectos jurídicos directos, pudiendo ser medidas de prueba que la administración produzca durante el procedimiento: pericias, declaraciones testimoniales, producción de pruebas, actas documentales o instrumentales, etc.

De acuerdo al artículo 1 de la Ley 27444 es:

Artículo 1.- Concepto de acto administrativo

1.1 Son actos administrativos, las declaraciones de las entidades que, en el marco de normas de derecho público, están destinadas a producir efectos jurídicos sobre los intereses, obligaciones o derechos de los administrados dentro de una situación concreta.
